Federal judge dismisses woman’s lawsuit against all homosexuals… is it really a surprise?


Do you remember how batshit crazy 66-year-old Sylvia Driskell filed a lawsuit in Nebraska against all homosexuals? Well never fear, it turns out the law has spoken out in favour of the defendant or should I say defendants? A federal judge has dismissed her lawsuit, so now homosexuals all over the world can breathe a big sigh of relief.


Judge John Gerrard dismissed the lawsuit filed against all homosexuals by Driskell in which she asked the court to decide once and for all whether homosexuality was a sin. In the seven-page, handwritten complaint, Driskell went as far as declaring “that homosexuality is a sin, and that they the homosexuals know it is a sin to live a life of homosexuality.”


The judge issued a  “strongly worded” opinion stating that it is not up to the court to decide whether homosexuality is sinful.

Omaha.com reports:

Gerrard said Driskell lacked subject matter jurisdiction and cannot sue a class of unidentified defendants. Driskell did not set forth a factual or legal basis for a federal claim.

“The United States Federal Courts were created to resolve actual cases and controversies arising under the Constitution and the laws of the United States,” Judge Gerrard said. “A federal court is not a forum for debate or discourse on theological matters.”

Gerrard declined to allow Driskell an opportunity to amend her complaint.
